Summary: The policy has been updated to specify its application to expanded learning opportunities beyond the regular school day, such as before-school, after-school, summer, vacation, and intersession programs. It also reflects new laws (AB 181 and AB 185, 2022) that update Expanded Learning Opportunities (ELO) program requirements that began with the 2022-23 school year. Detailed information about program collaboration requirements has been moved to the administrative regulation (AR). The regulation has been updated to define "offer access" and "provide access" in relation to Expanded Learning Opportunities (ELO) programs and moves detailed information on program collaboration requirements from the policy to the regulation. Updates also reflect new laws (AB 181 and AB 185, 2022), which revise ELO program requirements that began in the 2022-23 school year. These include the requirement for districts to offer ELO program access based on the prior fiscal year’s local control funding formula unduplicated pupil percentage. Additionally, the regulation clarifies that districts receiving funds for classroom-based instructional programs serving grades TK-6 cannot opt out of ELO program funding, as outlined in California Department of Education (CDE) guidance. Further updates require ELO programs to provide a nutritional snack, meal, or both and confirm that attendance is not mandatory, following CDE guidance. The regulation also reflects a new law (SB 1380, 2022), which renumbered the California Prekindergarten Planning and Implementation Grant Program from Education Code 8251.5 to 8322.
