Summary:
The Silver Valley Unified School District (“District”) and the Newberry Community Services District (“NCSD”) previously entered into an agreement, approved by this Board on January 10, 1985, through which the District granted NCSD use of the District property located at 33701-33793 Newberry Rd, Newberry Springs, CA 92365 for NCSD to operate a fire station and for other related uses. The term of the existing agreement is set to expire in 2025.

The District and NCSD desire to extend the term of the existing agreement and to amend certain terms and conditions in the existing agreement. Accordingly, the District has worked with legal counsel to prepare the First Amended and Restated Agreement presented with this agenda item as Exhibit A to Resolution No. 21-22-07. Pursuant to the First Amended and Restated Agreement, the term would be extended to September 15, 2041 and the monthly use value would remain at $1.00/year.
